Woman Is Suing SeaWorld After Being Struck In The Face By A Bird

I will be honest, when I heard a woman was suing SeaWorld, I had a different image in mind. I thought perhaps she slipped and fell while enjoying the park; however, that was not the case. While this woman did get injured during her time at SeaWorld, it is not what you would expect. A woman is suing SeaWorld after being struck in the face by a bird.

Woman Is Suing SeaWorld For Bizarre Reason

Not what you were expecting, right? Hiliary Martin was just trying to enjoy her day at SeaWorld Orlando. During her visit, she opted to ride one of the park’s attractions, the Mako rollercoaster. However, while she was on the ride, something surprising occurred.

What Martin thought was a duck flew into the coaster’s path and collided with her face. She then sued the park, claiming that “she suffered serious injuries after getting hit in the face by a duck.” SeaWorld naturally moved to dismiss the lawsuit. However, rather than claiming it didn’t happen, they pointed out that Ms. Martin had her facts wrong. It was not a duck that struck her in the face; it was a Snowy Egret.

Martin alleged that SeaWorld created a “zone of danger for bird strikes.” She argues that they did this by “placing the high-speed attraction near a body of water.” Due to that fact, she argues that is why the “duck” struck her in the face. PEOPLE shared that she is suing the park “on one count of liability, seeking more than $50,000 in damages for permanent injury, disability, physical impairment, and loss of earning power.”

Seems like a hefty thing for the woman to be suing SeaWorld for, will she be successful? Well, according to SeaWorld, her allegations are no longer true or valid. How did they come to this conclusion? They did so by proving that it was not a duck at all that struck Ms. Martin.

When attempting to dismiss her claims, the park shared that they investigated the incident and discovered Ms. Martin was struck by a “wild migratory Snowy Egret.” This bird is often found along the Atlantic and Gulf Coasts. Seeing as she was incorrect about the duck claim, SeaWorld attorneys added that her allegations are “no longer true or factual, nor are such allegations actionable against SeaWorld.”
